BALLOT MEASURE SUMMARY


Expands eligibility for the “Homestead Exemption” for veterans with a disability to include a veteran who does not have a service-connected disability rated as a 100% permanent disability but does have individual unemployability status.

Referred to the ballot by the 2023 legislature via 
HCR23-1002. Changes state constitution and requires 55% to pass.




BACKGROUND


Veterans may be eligible for this rating increase if they are either unemployed or unable to maintain substantially gainful employment as a result of their service-connected disability (or disabilities). 

“Substantially gainful” employment is simply full-time employment that provides a wage greater than the poverty level (currently under $12,316).

If approved by voters, the resolution increases state expenditures beginning in FY 2024-25, necessitating an annual appropriation through the state budget process.

Persons who are unable to work, whose earnings are inadequate, or for whom jobs are not available have the right to an income and/or services sufficient to meet their basic needs for food, shelter, and access to health care.

RATIONALE FOR STANCE

It is estimated that about 3,400 Colorado veterans who are not otherwise able to claim the homestead exemption will be able to do so with the measure’s passage.

This measure would help keep housed over 3,000 Coloradans who are unable to work and/or whose earnings are inadequate.
