RIGHTS IN RESIDENTIAL LEASE AGREEMENTS

One in four Colorado renters spend more than 50% of their income on housing and this financial burden can be exacerbated by excessive late fees, putting many Coloradans at risk of eviction. Colorado tenants facing eviction need to have due process of law. The current eviction court requirement that renters post a bond before they can assert their right to a habitable home as an eviction defense is not attainable by many low-income renters. The current recourse for a tenant experiencing an illegal lockout is to seek legal advice and to file a lawsuit against the landlord. These actions are out of reach for many tenants, especially low-income and undocumented tenants. Please urge your Senator to support this important legislation and establish penalties for landlords who illegally lock out tenants without a court order.
SB21-173 is scheduled for second reading on the Senate Floor on Tuesday April 6.
